about late fees. neighbors say they came to the front panel and they didn't think there was a problem. but when they stepped to the backside of the mailboxes, then they were knew they were in trouble. >> rosa says now she worries about identity theft. we found three different vandalized mailboxes in the neighborhood. affecting 36 people. >> they don't do nothing about it, for maybe two months. >> reporter: victims now have to get their mail at the post office. the property manager says she's trying to figure out who has to replace the mailboxes, the property owners or the post office? >> i'm worried about it, i don't know what to do now. >> reporter: the post office did not return our phone calls today. in san jose, damian trujillo, nbc bay area news. >> the alarming homicide rate, within the last 24 hours, the

35th and 36th homicides of the year have occurred. one of them was gang related according to police. this morning, friends set up a memorial for the man who was murdered just after midnight. he had been celebrating another friend's birthday outside of a house in east san jose when men with blue rags over their faces shot and killed him. he was in his 30s, married with a child. a friend tells us he doesn't understand why he would be targeted considering he wasn't in a gang himself. >> we were just hanging out. no gangbangers involved. there was nobody that gang bangs here. no colors whatsoever. we're just outside bbqing and all you hear is about three to four guys that were outside cooking, running for the house, and all you hear is shots fired, shots fired. the guy that had the shot runs into the house, dropped to the floor. >> another man was murdered in downtown san jose around 8:30 last night. police responded to a fight on second street near san fernando.

they found the victim unconscious, he then died at the scene. no arrests have been made in either crime. a prominent civil rights attorney is calling for a federal takeover of the oakland police department tonight as the city grapples with another wave of violence. john burris confirmed he and several other civil rights attorneys plan to file a request by midnight, asking a federal judge to appoint an independent receiver to take over at least portions of the police department. the request comes on the heals of two new reports by a federal monitor criticizing the department's handling of officer involved shootings and occupy oakland demonstrations. the department is making progress at implemes reforms and the mayor says the city will night to keep the police department under his control. wall, it's a big day for many bay area catholics and bay area gay rights activists. the appointment comes with controversy, the 56-year-old

the championship race? >> yeah, that's right. the first fleet race of this series just started, and the boats are in the process of rounding the reach mark right now, and they'll be heading away from the yacht club down toward the city front and it's going to be pretty exciting viewing down there shortly. >> i think they're watching our broadcast. if you turn around, you can see our photographer is getting them -- they're taking off right now. with the boats out here, people are new to watching something like this, what should they be looking for? >> well, the -- they set up a pretty closed course, the boats can't stray too far off that racetrack. they have to turn as they're sailing to make sure they don't go out of bounds. you'll see the boat turning as they sale up wind or jiving we call it as they sail down wind. those tacks and jives are really important tactically as the boats travel, because you can get an advantage over your opponent. >> it looks like we're just beyond -- we're turning around,

we hear that great location to be in front of, because that's where there can also be some of the most action. would you agree with that? >> absolutely. if you can get a viewing point near a marked boat, then that's where all the boats have to converge, they all have to go around that mark, you'll see them all. >> the other important thing, you being a chief meteorologist, and also myself, we know the weather we caught earlier this week, there was a lot of sunshine, not so great for the boats, but the fog coming in, cooler temperatures, we think it's going to be better for the competition tonight and this weekend? >> yeah, for sure. the cooler air coming in off the ocean is always stronger, it has more power in it, and these boats like a nice strong breeze because they can get up and out of the water and moving very quickly. we're looking forward to this weekend. >> real quick, right now, chris, it looks like oracle? may be number one? >> i kabt tell at this point, i'm just guessing. >> we'll say they are, i can't tell either. >> thank you so much, chris, for joining us and coming on out. you're going to join us in our 6:00 p.m. show. a lot of stuff happening out here on the waterfront.

the best part is a lot of this action happening this weekend is going to be absolutely free. let's get a look at your weather forecast. it's been ever changing, we went from record setting heat earlier this week all the way down to 50s and 60s, there's about a 40 degree drop in those numbers, we have plenty of 60s across the bay, and low to mid 70s down in the south bay. next 48 hours, we're going to continue the foggy breeze. no rainfall for friday and saturday, but it will start to get that drizzle going at the coastline. it's going to be a cool one, we're doing anything outside by the coast, expect 50s and 60s by the bay. 60s to 70s as the weekend pattern remains cooler. and also, plenty of wind. as for friday, we're going do top out at 76 in walnut creek. 75 in livermore, 76 in the almedden valley. san francisco, 67 degrees. it will be chilly, but we're expecting some sunshine to come on in.

let's get you the america's cup world series forecast. it will be televised on sunday as all of this action comes to a pinnacle. temperatures will stay in the 60s with winds 10 to 20 miles per hour, the cooler shift in the wind is boding much better for the sailors as they continue out here tonight. and this is actually the first time it's returning to the united states since 1995. getting back to its roots, the america's cup world series. we mentioned plenty of events. while you're out here watching the boats, fleet week will be up above, san francisco giants in the playoffs and much more action. a little bit of cloud cover, sun and overall, temperatures will remain cooler. on that 7-day forecast, we have low to mid-70s happening friday, saturday and sunday. and potentially a chance of some showers as we head into next monday and tuesday. again, america's cup world series happening behind us. fleet week up above this weekend. if that's not good enough for you, you can take a hike over to

tomorrow marks the one-year anniversary of the shooting at the cupertino cement plant. the man who says he was the shooter's friend offers his insight into why shareef opened

fire on his co-workers. it's a story you'll see only on nbc bay area. mary ann favreau talked with him today. she's live outside the quarry. >> reporter: some workers say team will be a difficult day for them. a painful reminder of the friends they lost. and today a former worker here talked to us, because he spent the last hours with allman before the shooting. a day on the job at the lehigh cement plant began with a predawn blood bath. witnesses say shareef allman pulled a gun from his waistband and began shooting during a safety meeting. three people were killed. >> it's hard. it's hard especially after someone you knew for years died. >> what motive did he have to gun down his co-workers?

in an exclusive interview, his friend talked to us about the conversation he had with allman at the bay 101 card club the day before the shooting. he was upset about being written up at work again for some company violation. >> his exact words were that -- they did not know how many guns i have, and that i can really hurt them was what he said. and at that point i discouraged him from the thought. >> reporter: he said he thought allman was just arrangery. deputies later shot him in a neighborhood, an autopsy showed he died from a self-inflicted gunshot wound to the head. a spokesman for the cement plant issued this statement, it has been nearly a year since the tragedy of october 2011 and our employees and families continued to mourn our shared loss. david says one of his other friends died in the shooting spree. >> i was just so sad that i

thought he wasn't going through it, and i -- maybe i should have done more. >> the plant has established a memorial garden here on site to honor those who were killed last year. in cupertino, mary ann favreau, nbc bay area news. >> tomorrow will be a painful day, marianne, thank you.
